The new law institutionalizes a certification program to enhance economic opportunities for LGBTQ+-owned enterprises

Governor Phil Murphy has officially signed bipartisan legislation that institutionalizes the certification program for LGBTQ+-Owned Businesses in New Jersey, a measure first introduced through Executive Order No. 295 in 2022. This legislative action, backed by both sides of the aisle and developed in collaboration with the Pride Chamber of Commerce, aims to bolster the state's economic health by supporting underrepresented business owners.

The program, managed by the New Jersey Department of the Treasury, offers a free certification that validates businesses as being at least 51% LGBTQ+ owned and controlled. This certification not only facilitates access to specific contracting opportunities and government programs but also allows businesses to promote their LGBTQ+ ownership status in marketing efforts. Valid for five years, the certification requires businesses to reapply upon expiration to maintain their certified status.

Today is a historic day for our LGBTQ+ community who will be recognized in New Jersey,” said Gus Penaranda, Executive Director of the NJ Pride Chamber of Commerce. "As the first state to codify the certification process for LGBTQ+ certifications. In times where our community is constantly silenced and attacked, this sends a clear message to all businesses looking to invest in New Jersey that we are a welcoming state."

As of today, the Department has certified 141 LGBTQ+ businesses, signaling a growing recognition and support for diversity in the state’s economic framework. This move aligns with New Jersey's broader commitment to inclusivity, as similar certification programs exist for small, minority-owned, women-owned, veteran-owned, and disabled-veteran-owned businesses.

The primary sponsors of the legislation, S1313/A3330, are Senators Nellie Pou and Teresa M. Ruiz, alongside Assemblymembers Benjie E. Wimberly, Sterley S. Stanley, and Donald A. Guardian, demonstrating a collective effort to foster an inclusive business environment in New Jersey.
